Employment-Based Immigration: first Preference EB-1

You may be qualified for an employment-based, first-preference visa if you are an alien of extraordinary ability, are an outstanding professor or scientist, or are a certain multinational executive or supervisor. Each occupational classification has certain requirements that need to be fulfilled:

In order to show you are an outstanding teacher or researcher, you need to include proof of 2 of the 6 listed criteria listed below (or similar proof if any of the requirements do not easily apply):

– Evidence of membership in associations that need their members to show exceptional achievement

Application Process

Ability: You might obtain yourself by filing a Type I-140, Petition for Alien Worker.

Outstanding Professors and Researchers: Your U.S. company must submit a Form I-140, Petition for Alien Worker. As part of the application process, your employer should be able to show a continuing capability to pay the provided wage as of the priority date. Multinational Manager or Executive: Your U.S. company must submit USCIS Form I-140, Petition for Alien Worker.
